Gemify Innotech Private Limited (“Gemify Innotech”, “we”, “us”) respects your privacy. This policy explains what personal data we collect through gemifyinnotech.in, why we collect it, and what rights you have. We handle personal data in line with the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
What we collect
- Details you give us — name, company, email address, phone number and the contents of your enquiry when you submit a form, email us or call.
- Technical data — IP address, browser type, device type, pages visited and time spent, collected through server logs and analytics tools.
- Client project data — where you engage us for services, any data you share with us for the purpose of delivering that work.
Why we use it
- To respond to your enquiry and prepare a quotation.
- To deliver, support and invoice the services you have engaged us for.
- To meet statutory obligations under tax, company and other applicable law.
- To improve the website and understand which pages are useful.
We do not sell your personal data. We do not share it with third parties for their own marketing.
Who we share it with
Only where necessary: our hosting and email providers, analytics services, payment processors, and our professional advisers such as our chartered accountant. Each is expected to protect the data and use it only for the purpose we engaged them for. We may also disclose data where required by law or by a court or government authority.
How long we keep it
Enquiry data is retained for up to three years so we can maintain continuity if you come back to us. Client project and financial records are retained for the period required by Indian tax and company law, typically eight years. You may ask us to delete data earlier where we are not legally required to keep it.
How we protect it
Access is restricted to the team members who need it, credentials are stored in a password manager rather than shared documents, transmission to this website is encrypted with HTTPS, and our systems are patched on a schedule. No system is perfectly secure, but we take reasonable technical and organisational measures appropriate to the risk.
Your rights
You may ask us to confirm what personal data of yours we hold, correct anything inaccurate, delete data we no longer need, or withdraw consent for marketing communication. Write to info@gemifyinnotech.in and we will respond within a reasonable period.

Terms of Service
By using this website or engaging Gemify Innotech Private Limited for any service, you accept the following terms. Where a signed agreement, work order or quotation exists between us, that document takes precedence over these terms to the extent of any conflict.
Scope of work
Services are delivered strictly as described in the accepted quotation or work order. Anything not listed there is out of scope and will be quoted separately as a change request before work on it begins.
Client responsibilities
You agree to provide content, approvals, access credentials and feedback within the timelines agreed in the project plan. Delays on your side move the delivery date accordingly. You confirm that any content, logo, image or data you supply is either owned by you or properly licensed for the use intended.
Payments
Payments are due against milestones stated in the quotation. Applicable GST is charged on all invoices. Work may be paused on overdue invoices after written notice. Third-party costs such as domains, hosting, licences, stock media and advertising spend are billed at actuals unless expressly included.
Intellectual property
On receipt of full payment, ownership of the deliverables created specifically for you transfers to you. Pre-existing tools, libraries, frameworks and internal components used to build them remain ours or their respective licensors’, and are provided to you under the licence necessary to use the deliverable. Open-source components remain governed by their own licences.
Warranty and support
We warrant that delivered work will function as described in the approved scope, and we will fix defects reported during the warranty period stated in your quotation at no charge. The warranty does not cover changes made by you or a third party, hosting or third-party service failures, or new requirements.
Limitation of liability
To the extent permitted by law, our total liability arising from any engagement is limited to the fees actually paid to us for that engagement. We are not liable for indirect or consequential losses, including loss of profit, business or data, except where caused by our wilful misconduct.
Confidentiality
Each party will keep the other’s confidential information private and use it only for the purpose of the engagement. We will sign your NDA on request, and will not name you as a client or show your project publicly without written permission.
Governing law
These terms are governed by the laws of India. Courts at Delhi have exclusive jurisdiction over any dispute.
Refund & Cancellation Policy
Our services are custom professional work, delivered against time already spent. This policy sets out when money is and is not returned.

| Cancelled before any work begins | Advance refunded in full, less any third-party costs already incurred on your behalf. |
| Cancelled mid-project | You are billed for work completed and third-party costs incurred to that date. Any balance from the advance is refunded. |
| Milestone already delivered and approved | Non-refundable, as the work has been supplied and accepted. |
| Third-party purchases | Domains, hosting, licences, stock media and ad spend are non-refundable once purchased. |
| Monthly retainers and AMC | Cancel with 30 days’ written notice. The current period is not refunded; no further periods are billed. |
| Defective delivery | We fix it. If we genuinely cannot deliver what was agreed, the amount paid for that portion is refunded. |
Refund requests should be sent in writing to info@gemifyinnotech.in. Approved refunds are processed to the original payment method within 7 to 14 working days.
